1. Acceptance of These Terms

2. Store Identity and U.S. Sales Territory

doghazalusa.com is operated by Nimehav LLC as an authorized U.S. online retailer for Do Ghazal and Alghazaleen tea products. Karabetian Import & Distribution, Inc. is the sole authorized U.S. distributor for those brands.

doghazalusa.com sells and ships products only within the United States, and we may refuse or cancel orders outside our authorized sales territory.

3. Accounts and Accurate Information

You may need to provide information such as your name, email address, shipping address, billing address, and payment information to place an order or use certain features. You agree to provide accurate, current, and complete information and to update it as needed.

You are responsible for keeping any account credentials confidential and for all activity under your account. Notify us promptly if you believe your account has been accessed without authorization.

4. Products, Packaging, and Product Information

Product images, packaging, labels, colors, and appearance may vary from what appears on your screen or from prior product packaging. We try to display products accurately, but we do not guarantee that your device's display or the images on the site will exactly reflect the product you receive.

Product photographs, thumbnails, marketing images, descriptions, product data, prices, available sizes, available quantities, packaging details, and other website content may be updated, changed, corrected, or discontinued without notice.

5. Food and Beverage Use, Caffeine, Ingredients, and Allergens

Many tea products naturally contain caffeine unless specifically labeled caffeine-free or decaffeinated. Caffeine content may vary by product, serving size, and preparation method. Customers who are sensitive to caffeine, limiting caffeine intake, pregnant or nursing, purchasing for children or teens, taking medication, or managing a health condition should review the product packaging and consult a qualified healthcare professional with any questions before use.

Ingredients, allergen information, preparation instructions, caffeine-related information, and other product details may appear on product packaging or product pages. You are responsible for reviewing all product packaging, labels, warnings, ingredients, allergen information, and instructions before consuming or serving any product. You should not consume or serve any product if you have a known or suspected allergy, sensitivity, dietary restriction, caffeine sensitivity, or other health-related concern unless you have reviewed the product label and consulted a qualified professional where appropriate.

6. California Proposition 65 Notices

Some products may be subject to California Proposition 65 warning requirements if they expose California consumers to one or more chemicals listed by the State of California as known to cause cancer, birth defects, or other reproductive harm at levels requiring a warning.

7. Orders, Acceptance, Pricing, and Availability

Your order is an offer to purchase only. We reserve the right to accept, decline, limit, or cancel any order for any reason permitted by law, including suspected fraud, resale, marketplace resale, export, pricing errors, inventory errors, or unauthorized commercial activity.

Prices, discounts, promotions, product availability, and product information may change without notice. We reserve the right to correct errors, inaccuracies, or omissions and to update information or cancel orders if any information is inaccurate, including after an order has been submitted.

We may limit quantities available for purchase. We do not guarantee that products shown on the Services will be available at all times.

8. Personal Use, No Resale, and No Marketplace Sales

Products purchased through doghazalusa.com are intended for personal or household use only. Without our prior written authorization, you may not purchase products for resale, redistribution, wholesale supply, export, or resale through any third-party marketplace or marketplace platform, including, without limitation, Amazon, Walmart Marketplace, eBay, or similar channels. We reserve the right to refuse, limit, or cancel any order that we believe may violate this policy.

You may not use our products, website, product data, pricing, images, or materials for unauthorized resale, marketplace listings, export, commercial cataloging, or other commercial activity without our prior written authorization.

9. Shipping, Delivery, and Risk of Loss

Shipping and delivery dates are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, incorrect addresses, service interruptions, customs processing, or events outside our reasonable control.

Once an order is shipped, delivery is handled by the carrier. Risk of loss passes as permitted by applicable law. Please contact us at support@doghazalusa.com if your order is delayed, lost, damaged, or marked delivered but not received.

You are responsible for providing a complete and accurate delivery address. We are not responsible for failed delivery caused by incorrect or incomplete information provided by you.

10. Returns and Refunds

Returns, refunds, replacements, and related requests are handled according to our Refund Policy.

We may require proof of purchase, photos, product details, packaging information, carrier information, or other information reasonably needed to review a request.

11. Reviews, Comments, Photos, Testimonials, Suggestions, and Feedback

If you submit reviews, comments, photos, testimonials, suggestions, ideas, feedback, or other content to us or through the Services, you grant Nimehav LLC a non-exclusive, worldwide, royalty-free, sublicensable, transferable right to use, reproduce, display, publish, distribute, adapt, edit, translate, create derivative works from, and otherwise use that content for operating, improving, marketing, and promoting doghazalusa.com and the products offered through the Services, subject to our Privacy Policy.

You represent that you have the rights needed to submit the content and grant this permission. You may not submit content that is false, misleading, unlawful, infringing, abusive, obscene, defamatory, or otherwise objectionable.

The website design, layout, text, graphics, images, product photos, product descriptions, product data, pricing presentation, page structure, reviews, videos, audio, and other materials available through the Services are protected by intellectual property and other laws.

Do Ghazal, Alghazaleen, Akbar Brothers, Shopify, and other names, logos, trademarks, service marks, and trade dress appearing on the Services remain the property of their respective owners or are used with authorization. Nothing in these Terms grants you any right to use any trademark, logo, brand name, product image, product data, or website material except as expressly permitted by law or by our prior written authorization.

14. Third-Party Services and Shopify Relationship

doghazalusa.com is powered by Shopify. Purchases are made directly with Nimehav LLC, operator of doghazalusa.com, and not Shopify.

We may use third-party apps, payment processors, shipping providers, analytics services, marketing tools, review tools, support tools, fraud prevention tools, hosting providers, and other service providers to operate and improve the Services. These third parties may have their own terms, privacy notices, or policies.

We are not responsible for third-party websites, platforms, services, or content that we do not control.

Our collection, use, and disclosure of personal information is described in our Privacy Policy.

16. Warranty Disclaimer

To the fullest extent permitted by law, the Services, website content, product information, and all products are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory.

To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted or error-free operation.

Some jurisdictions do not allow certain warranty limitations, so some of the above may not apply to you.

17. Limitation of Liability

To the fullest extent permitted by law, Nimehav LLC and its owners, officers, employees, contractors, agents, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, business interruption, or similar losses arising from or related to the Services, products, these Terms, or your use of or inability to use the Services.

To the fullest extent permitted by law, our total liability for any claim arising from or related to the Services, products, or these Terms will not exceed the amount you paid for the product or order giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law.

18. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Nimehav LLC and its owners, officers, employees, contractors, agents, service providers, and affiliates from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to your violation of these Terms, misuse of the Services, unauthorized resale, marketplace resale, export, redistribution, scraping, data extraction, automated access, prohibited activity, content you submit, or violation of any law or third-party right.

19. Suspension, Restriction, Refusal of Service, and Termination

We may suspend, restrict, refuse service, cancel orders, block accounts or access, or terminate access to the Services if we believe, in our reasonable judgment, that you have violated these Terms, engaged in fraud, attempted unauthorized resale or marketplace resale, used automated access without authorization, violated our sales-territory limits, created risk for us or others, or engaged in activity that is unlawful or harmful, where permitted by law.

20. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

You agree that any dispute arising from or related to these Terms, the Services, or products purchased through doghazalusa.com will be brought in the state or federal courts located in California, unless applicable law requires otherwise.

21. Changes to These Terms

We may update these Terms from time to time. Revised Terms may be posted on doghazalusa.com and are effective when posted unless a later date is stated. Where required by law, we will provide notice of material changes.

Your continued use of the Services after revised Terms become effective means you accept the revised Terms.

If any part of these Terms is found unenforceable, the remaining parts will remain in effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.
